Settlement Agreement Advice for Employees in Cirencester

A settlement agreement should be reviewed against both the financial offer being made and the payments your employer already owes you. We advise employees in Cirencester on the complete document before it is signed, including the legal terms that bring the employment relationship to an end.

Our review checks the proposed compensation, contractual payments, termination arrangements, reference wording and restrictions after employment. We also identify which claims you are being asked to settle and any provisions that should be clarified or amended.

What Payments Should Be Included?

The settlement payment is separate from sums that may already be due under your contract or as a result of your termination. We check the figures in the agreement and how each payment is described.

  • Compensation or ex-gratia payment
  • Salary up to the termination date
  • Notice pay or payment in lieu of notice
  • Accrued but untaken holiday
  • Redundancy pay where applicable
  • Bonus, commission or other sums where relevant

What Legal Terms Do We Review?

The agreement will usually contain obligations that continue after your employment has ended. These provisions need to be considered alongside the financial terms.

  • Tax wording and tax indemnities
  • Reference wording
  • Confidentiality provisions
  • Statements about the employer or colleagues
  • Restrictions affecting future work or clients
  • The employment claims being settled
  • Return of property and documents
  • The employer's legal fee contribution

How Quickly Can We Review the Agreement?

Settlement agreements are often issued with a response deadline. For straightforward matters, we aim to complete the initial review within 24 hours of receiving the complete agreement, subject to solicitor availability and the complexity of the terms.

  • Send the complete agreement and any accompanying documents
  • Tell us the deadline given by your employer
  • Urgent and same-day appointments may be available
  • Negotiation or substantial amendments may require more time

Who Usually Pays the Solicitor's Fees?

Most settlement agreements provide for the employer to contribute towards the cost of the independent legal advice required before the agreement is signed. Our standard fees are typically £350–£700 plus VAT, depending on the agreement and the work required.

For a straightforward review and sign-off, the employer's contribution will usually cover our fee, so there is normally nothing for you to pay personally.

If the matter requires additional negotiation or more extensive advice, we will discuss this with you first and, where appropriate, seek an increased contribution from your employer.

Can We Ask for Changes Before You Sign?

Yes. The terms are not final until the agreement is signed. If the payment is too low, a sum has been omitted, the reference wording is unsuitable or a restriction may cause difficulty in your next role, those points can be raised before completion.

We can advise which amendments are appropriate and, if instructed, negotiate directly with your employer or their solicitor.

We advise employees in Cirencester and surrounding areas including the town centre, Chesterton, Stratton, Watermoor, Kingshill, Siddington and nearby Cotswold communities. Advice is available by telephone or video, with in-person appointments by arrangement.
